Terms of Services

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Fluentade platform ("Fluentade" or the "Platform"). By accessing or using Fluentade, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Fluentade is operated by LanterNode, a company incorporated in the Republic of Korea. Fluentade is a language-learning software-as-a-service (SaaS) platform that enables teachers and students to manage lessons, track learning progress, and access follow-up learning materials. These Terms describe the rights, obligations, and responsibilities that apply when you use the Platform.
Where applicable, any separate written agreement you enter into with us (including enterprise or custom service agreements) will take precedence over these Terms to the extent of any conflict.

3. Account Registration
To use Fluentade, users (including teachers, students, and organizations) must create an account and provide accurate and up-to-date information.
You are responsible for maintaining the confidentiality of your login credentials and all activities conducted under your account. You agree not to share your account with any third party, use another person’s account, or impersonate another individual.
You must be at least 14 years old, or the applicable age of digital consent under Korean law. Users below this age may only use the Service with verified parental, guardian, or institutional consent, as required by law.
4. Service Access and Usage Rights
LanterNode grants you a limited, non-exclusive, non-transferable, revocable right to access and use Fluentade in accordance with these Terms.
You may not:
- Reverse-engineer, decompile, or attempt to derive the source code of any part of the Platform.
- Copy, modify, or create derivative works based on Fluentade.
- Attempt unauthorized access to servers, accounts, or data.
- Use Fluentade to store or transmit unlawful, harmful, infringing, or abusive content.
- Misuse audio recordings or violate the privacy rights of teachers, students, or third parties.
LanterNode may suspend or restrict access if required for security reasons, misuse, non-payment, or legal compliance.
5. Learning Data and Audio Recordings
Fluentade processes the following data to operate the Service:
- Student learning progress and activity data
- User-generated learning content
- Audio recordings of teacher–student sessions (where enabled)
By using the Service, you grant LanterNode the rights necessary to store, process, and display such data solely for the operation, improvement, and security of the Platform.
Users (including teachers and institutions) are responsible for:
- Informing and obtaining consent from students or legal guardians regarding audio recordings
- Ensuring that the creation and use of such recordings comply with all applicable laws, including the Korean PIPA (Personal Information Protection Act)

6. Payments, Subscriptions, and Refunds
Fluentade offers paid subscription plans. Payment processing may be handled via PayPal for international users and bank transfer for users in Korea.
Information on subscription features, billing periods, automatic renewal, and pricing is displayed at the time of purchase.
Refunds are provided only:
- When required by applicable consumer protection laws of Korea, or
- When explicitly stated in a specific plan or written agreement.
LanterNode may adjust subscription pricing for future billing cycles. Any price changes will be announced in advance and will not retroactively affect previously paid periods.
7. Intellectual Property
All software, design elements, trademarks, service marks, and other materials within Fluentade are owned by LanterNode or licensed to us.
Users may not copy, reproduce, modify, distribute, or create derivative works from the Platform without prior written authorization.
Content uploaded by teachers or students remains their respective property. However, by uploading content, you grant LanterNode a limited, worldwide, royalty-free license to store, process, and display that content as necessary to provide the Service.
8. Service Availability and Disclaimer
Fluentade is provided on a commercially reasonable, best-effort basis.
LanterNode does not warrant:
- Uninterrupted or error-free operation
- That the Service will meet every user requirement
- Compatibility with all devices, browsers, or network conditions
To the extent permitted by law, all implied warranties (including merchantability and fitness for a specific purpose) are disclaimed.
9. Limitation of Liability
To the fullest extent permitted under Korean law, LanterNode is not liable for:
- Indirect, incidental, punitive, special, or consequential damages
- Loss of profits, data, reputation, or expected benefits
- Damages arising from user actions, misuse, or third-party services
Where liability cannot be legally excluded, it is limited to the total amount paid by you for the Service during the preceding 12 months.
10. Third-Party Links and Integrations
Fluentade may provide links to external websites or integrate with third-party services (such as PayPal). LanterNode is not responsible for the availability, accuracy, security, or privacy practices of these external services.
Your use of third-party services is governed by their respective terms and policies.
11. Data Protection and Privacy
Use of Fluentade involves the processing of personal data.
Our Privacy Policy explains:
- What data we collect
- How and why it is used
- How long data is retained
- Where audio recordings are stored
- Your rights under the Korean PIPA and other applicable laws
By using Fluentade, you confirm that you have reviewed the Privacy Policy.
The Data Processing Agreement (DPA) applies to all account holders who process personal data through Fluentade, including organizations, schools, institutions, freelance teachers, and individuals who work with students.
12. Modifications to These Terms
LanterNode may update these Terms from time to time for legal, operational, or service-related reasons.
- Updates will be posted on the Platform.
- Material changes may also be notified by email or in-service notification.
- Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Korea.
Any disputes will be resolved by the competent courts of Seoul, unless local consumer protection laws grant you mandatory rights to other venues.
